1. Acceptance of Terms

Welcome to Yao App, a mobile application owned & operated by Parmanand & Sons Medical Stores ("we," "our," "us"). These Terms and Conditions ("Terms") govern your access to and use of our mobile application, website, services, and any related content (collectively, the "Service").

By downloading, installing, accessing, or using our Service, you ("User," "you," "your") acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

  • You must be at least 18 years of age to use the Service and purchase any product.
  • You must be competent to enter into a legally binding contract under Indian law.
  • By using the Service, you represent and warrant that you meet these eligibility criteria.

3. Account Registration and Security

  • You may need to register an account to access certain features.
  • You agree to provide accurate, current, and complete information during registration and to update it promptly.
  • You are responsible for safeguarding your account password and for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.

4. Nature of Service and Health Disclaimer

Platform Role

We are an intermediary platform that facilitates the sale and delivery of products from licensed pharmacists, retailers, and partners ("Partners"). We are not a pharmaceutical company or a healthcare provider.

Not Medical Advice

The information provided on the Service, including product descriptions, articles, or FAQs, is for informational purposes only and is NOT a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

No Doctor-Patient Relationship

The use of the Service does not create a doctor-patient relationship between you and us.

5. Orders and Financial Terms

Pricing

All prices are listed in Indian Rupees (₹). We reserve the right to correct any pricing errors and to change prices without prior notice.

Payment

You agree to pay all charges incurred by you at the posted prices. You authorize us to charge your chosen payment method for the total amount of your order.

Order Acceptance

Your order is an offer to purchase. We reserve the right to refuse or cancel any order for reasons including product unavailability, pricing inaccuracies, or suspicion of fraud.

Taxes

You are responsible for all taxes, duties, or other governmental charges associated with your purchase.

6. Prescription Medicines Policy

Valid Prescription Required

The purchase of prescription medicines requires a valid, unexpired prescription from a registered medical practitioner licensed in India.

Uploading Prescriptions

You will be required to upload a clear, legible copy of your prescription. This prescription will be verified by our Partner pharmacists.

Verification

We reserve the right to cancel any order for prescription medicines if the prescription is invalid, unclear, expired, or appears to be forged.

One Prescription, One Order

A prescription can only be used for a single order. For recurring orders, a new valid prescription may be required.

Prohibited Substances

The sale of narcotic drugs, psychotropic substances, and any other medicines banned under Indian law is strictly prohibited.

7. Returns, Refunds, and Cancellations

General Policy

Due to the nature of the products sold (medicines, cosmetics, personal care), we follow a "No Return/No Refund" policy for products that have been delivered, unless explicitly stated otherwise.

Exceptions

Returns or refunds may be considered only under specific circumstances, such as:

Damaged/Expired Products

The product received is damaged, expired, unused, sealed or tampered with.

Wrong Product

The wrong product was delivered.

Cancelled Orders

The order was cancelled by us or our Partners before shipment.

Process

To request a return/refund, you must contact our customer support within 24 hours of delivery and provide necessary evidence (e.g., photos/videos of the damaged or incorrect product). The final decision rests with us.

Cancellation by User

You may cancel an order before it has been shipped. Once an order is shipped, it cannot be canceled.

8. Delivery

  • We deliver across India. Delivery times are estimates and not guaranteed.
  • You are responsible for providing a complete and accurate delivery address.
  • At the time of delivery, you may be required to produce a valid government ID and, for prescription medicines, the original prescription for verification.
  • Risk of loss for products passes to you upon delivery.

9. User Conduct and Responsibilities

You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose.
  • Upload a forged or invalid prescription.
  • Resell products purchased through the Service.
  • Tamper with, reverse engineer, or hack the Service.
  • Use the Service in any manner that could disable, overburden, or impair it.
  • Upload any content that is defamatory, obscene, or infringes on any third-party rights.

10. Intellectual Property

The Service, including its text, graphics, logos, and software, is our property or the property of our licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive license to use the Service for personal, non-commercial use.

11. Limitation of Liability

To the fullest extent permitted by law, Parmanand & Sons Medical Stores, its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to:

  • Any reliance placed by you on the completeness or accuracy of information on the Service.
  • Any delay or inability to use the Service.
  • The procurement of substitute products or services.
  • Any products sold or delivered by our Partners.

Our total cumulative liability towards you for all claims shall not exceed the total amount you paid for the specific product giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Parmanand & Sons Medical Stores and its affiliates from any claim, demand, loss, or damage (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, your violation of any law, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

14. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

Jurisdiction

The courts in Nagpur, Maharashtra, India shall have exclusive jurisdiction over any disputes arising under these Terms.

Dispute Resolution

In the event of any dispute, we encourage you to first contact us directly to seek a resolution. If unresolved, it may be referred to arbitration.

In compliance with the Information Technology Act, 2000, the name and contact details of the Grievance Officer are provided below. You may contact them for any complaints or concerns, including for the violation of these Terms.

We will acknowledge your complaint within 24 working hours and resolve it within 15 days.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, either by in-app notification, email, or by posting a notice on the application. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
